Please read these Terms of Service ("Terms") carefully before using the Voxet platform, operated by Posterior Technologies Private Limited, also known as Posterior AI ("Company", "us", "we", or "our"). These Terms govern your access to and use of our services. By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you are not authorized to use our services.
1. Description of Service:
1.1. Our platform provides generative text AI services, allowing the user to upload media and convert to text that represents the uploaded media.
1.2. Our platform generates text based on the media provided. It is designed to delete the provided media within 24-hour period after successful completion of the process. The data is automatically deleted from our systems. This only pertains to remote cloud service.
2. User Responsibilities:
2.1. User Accounts: In order to access and use our services, you may be required to create a user account. You are responsible for maintaining the confidentiality of your account credentials and for any activities that occur under your account. You agree to provide accurate, current, and complete information during the registration process and to promptly update any changes to your account information.
2.2. Compliance with Laws: You agree to use our services in compliance with all applicable laws, regulations, and third-party rights. You are solely responsible for ensuring that the media you upload and the processing tasks you request comply with these legal requirements.
2.3. Prohibited Activities: You must not use our services for any unlawful, abusive, or unauthorized purposes. This includes, but is not limited to, uploading or processing media that infringe upon intellectual property rights, contain explicit or offensive content, or violate the privacy rights of others.
3. Intellectual Property:
3.1. Ownership: We retain all rights, title, and interest in and to our platform, including any intellectual property rights associated with it. Your use of our services does not grant you any ownership or rights to our intellectual property.
3.2. User Content: By uploading media to our platform, you represent and warrant that you have the necessary rights or permissions to use, process, and transmit such media. You retain ownership of any media you upload, and you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and perform the necessary processing tasks on these media solely for the purpose of providing the requested services.
3.3. AI Models: You retain ownership of all the models generated through this platform, as long as they are in step with the licenses dictated by those models' licenses.
4. Limitation of Liability:
4.1. To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use or inability to use our services, even if we have been advised of the possibility of such damages.
4.2. We make no warranties or representations regarding the accuracy, reliability, or availability of our services. We do not guarantee that the services will be uninterrupted, error-free, or secure.
5. Privacy:
5.1. Our collection, use, and retention of personal information are governed by our Privacy Policy. By using our services, you consent to the collection and use of your personal information as outlined in the Privacy Policy.
6. Return and Refund Policy:
6.1. No Returns or Refunds: We do not offer returns, refunds, or exchanges for our services. All purchases are final and non-refundable. Please consider this policy carefully before subscribing to our services.
7. Subscription Terms:
7.1. Subscription Services: We offer various subscription plans for our services. By subscribing, you agree to pay the subscription fees for the services you select in accordance with the pricing and payment terms presented to you at the time of purchase.
7.2. Automatic Renewal: Unless you notify us before the end of the applicable subscription period that you want to cancel a subscription, your subscription will automatically renew and you authorize us to collect the then-applicable annual or monthly subscription fee (as well as any taxes) using any credit card or other payment mechanism we have on record for you.
7.3. Cancellation Policy: You may cancel your subscription at any time. Please note that you must cancel your subscription before it renews in order to avoid being charged for the next subscription period's fees.
7.4. Refunds: Subscriptions are non-refundable and non-transferable. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account.
